MONROVIA, Liberia – The Liberia Electricity Regulatory Commission (LERC) has rejected LIBENERGY’s application for reconsideration of its July 6, 2026 tariff decision, confirming that the approved electricity tariff will take effect on November 1, 2026.
Speaking on behalf of the Commission, LERC Chairman Hon. Claude J. Katta said the decision followed a thorough review of LIBENERGY’s application, supporting submissions, the tariff record, and the relevant provisions of the Electricity Law of Liberia, 2015. He said the Commission found that the utility failed to present any legal, factual, or procedural basis to justify a review of the tariff decision.
Chairman Katta noted that LIBENERGY had requested the Commission to reinstate its proposed energy charge of US$0.25 per kilowatt-hour (kWh), arguing that the approved tariff of US$0.22/kWh was not cost-reflective. Alternatively, the company sought a postponement of the implementation of the approved tariff.
According to the LERC Chairman, the issues raised in the application merely repeated arguments that had already been fully considered during the tariff review process and did not identify any material error of law or fact. As a result, the Commission rejected the request for reconsideration.
Although the application was denied, Chairman Katta explained that the Commission exercised its regulatory authority to defer implementation of the approved tariff from August 1 to November 1, 2026. He said the extension follows the expiration of the four-month compliance period previously granted to LIBENERGY to address identified service delivery deficiencies.
“The postponement does not modify or reverse the Commission’s tariff determination, nor does it validate LIBENERGY’s assertion that the approved tariff is not cost-reflective,” Chairman Katta emphasized. “Rather, the extension is intended solely to provide the utility with additional time to implement corrective measures and demonstrate measurable improvements in the quality, reliability, and efficiency of its services.”
He reaffirmed the Commission’s commitment to safeguarding the public interest through transparent, fair, and evidence-based regulation, assuring customers, stakeholders, and local government officials that LERC will continue to closely monitor LIBENERGY’s compliance with its regulatory obligations and service improvement commitments.
Chairman Katta said the Commission remains committed to ensuring that electricity consumers receive safe, reliable, and efficient services while holding regulated utilities accountable to the standards established under Liberia’s electricity laws and regulatory framework.
With the Commission’s decision, the approved electricity tariff remains unchanged and is scheduled to take effect on November 1, 2026.
